Architecture and
Engineering are learned professions legally recognized in this state to safeguard life,
health and property and to promote the public welfare. It is a matter of public interest
that these professions discharge their professional duties with such fidelity to their
clients and the public as to warrant the utmost confidence.. It is incumbent upon these
professions to prevent confusion in the laymans mind in those similar or overlapping
fields of professional practice. .This statement is adopted by the Arkansas Board of
Registration for Professional Engineers and Land Surveyors and the Arkansas State Board of
Architects to form an ethical guide for all licensed architects and engineers in their
dealings with the members of both professions. All persons registered to practice in these
professions in this state have the obligation to observe it as such. |

| 2. |
That
registered engineers should not have the privilege of calling themselves or setting
themselves forward as an architect, or practicing architecture, unless they are also a
registered architect meeting the requirements for such registration for the State of
Arkansas, and that if they so designate themselves as an architect without being
registered, they are in violation of the law. |

|
| 3. |
That
registered architects should not have the privilege of calling themselves or setting
themselves forward as an engineer, or practicing engineering, unless they are also a
registered engineer meeting the requirements for such registration for the State of
Arkansas, and that if they so designate themselves as an engineer without being
registered, they are in violation of the law. |

| 4. |
Each
engineer and architect will familiarize themselves with the registration laws of both
professions and will not knowingly violate such laws. Engineers or architects shall
undertake to perform professional services only when they together with those whom the
engineer or architect may engage as consultants, are qualified by education, training and
experience in the specific technical areas involved. Either an engineer or architect
registered in Arkansas may serve as the principal professional. No engineer or architect
shall approve, sign or affix their name or seal as architect or engineer to any plan,
specification, drawing or other related document which was not prepared by them or under
their supervision. |

| 5. |
Each
engineer and architect shall become familiar with all state, federal and local laws, rules
or ordinances relating to the projects with which each is engaged, and not knowingly
design a project in violation of such regulations. |

|
| 6. |
Each
board will continue to evaluate the existing laws of the two professions in order to
minimize misunderstandings concerning qualifications and practice under the laws. |
|
|
|
| 7. |
The
Arkansas Engineering and Architectural Acts classify building according to their intended
purpose: |
|
|
|
|
A. |
The design of
buildings intended for accommodation of equipment, vehicles, goods and/or processes or
other utilitarian functions, with human occupancy including office space as required for
the support of these functions constitutes the Practice of Engineering (A.C.A. 17-30-104). |
|
|
|
|
B. |
The design and
construction of buildings for human occupancy or habitation constitutes the Practice of
Architecture (A.C.A. 17-15-102). |
|
|
|
| 8. |
Incidental
practice means the performance of any service or design which is a small part of a larger
project and is simple in design or minor in cost and for which the practitioner is
qualified. |
|
|
|
| 9. |
Design
professionals performing incidental service or design must be prepared to: |
|
|
|
|
A. |
Demonstrate
qualifications and competency in the area of incidental practice. |
|
|
|
|
B. |
Demonstrate that the
life, health, property and welfare of the public is not comprised by performance of the
incidental design. |
|
|
|
|
C. |
Accept full
responsibility for the incidental design or service. |
|
|
|
| 10. |
That a
copy of this resolution be forwarded by these Board to all professionals registered to
practice engineering or architecture in the State of Arkansas. |
