Notice to 2010 Licensees |

PLEASE READ
NEW RULES REGARDING CE, AUTHORIZING AGENTS, APPRENTICESHIPS, ETC HAVE BEEN ADOPTED AND ARE NOW IN FORCE. DUE TO TIMING, WE WILL ONLY ENFORCE THE NUMBER OF HOURS THIS RENEWAL PERIOD. 6 HOURS, 3 HOURS CARRY OVER. ADDITIONALLY, WE WERE UNABLE TO CHANGE THE RENEWAL DUE DATE FOR 2010 DUE TO STATUTORY CONFLICTS, THEREFORE THE RENEWAL DATES REMAIN THE SAME, PAYABLE BY DECEMBER 31, 2009. PENALTIES START FEBRUARY 1, 2010, $50.00 PER QUARTER, PER LICENSE. WE ENCOURAGE YOU TO RENEW BEFORE DECEMBER 31, 2009 AS WE ARE GOING TO CHANGE THIS DATE AS SOON AS POSSIBLE.
LICENSE RENEWAL & CONTINUING EDUCATION REPORTING
You must report 6 Hours in order to renew your licenses(s). Please report all hours earned. If you have hours to carry over for next year (a maximum of 3 hours) please report those on this renewal. If you reported carryover hours last year, we will have a record of those on file. DO NOT SEND YOUR INDIVIDUAL PROOF DOCUMENTS. It is the licensee’s responsibility to keep track of hours; those documents are for your records. To check for compliance, the Board will conduct a random survey of renewal forms and cross check them against attendance rosters. Remember to complete the reverse side of your renewal form. If it is not complete; it will be returned.
EXEMPTIONS FROM CONTINUING EDUCATION
If you were licensed this year, you are exempt. If you are inactive (not working), you are exempt. If you are 65 years of age, and have had a license for 20 consecutive years, you are exempt. If you have a lifetime license, you are exempt. If you live out of State and do not practice in the State of Arkansas, you are exempt. Indicate what exemption you are claiming by writing on the renewal form.
ILL OR DISABLED EXEMPTION FROM CE
If you are seriously ill or disabled, the Board must be notified and provided with proper documentation from your personal physician. This documentation must be returned with your renewal. The Board will review such exemption requests on a case by case/year by year basis. If you are practicing Funeral Directing and or Embalming at all, you may not claim this exemption.
LICENSE RENEWALS MUST BE IN OFFICE BY JANUARY 31, 2010. LICENSES RECEIVED AFTER THE 31ST ARE DELINQUENT AND LICENSEES ARE PROHIBITED FROM WORKING. LICENSEES FOUND IN VIOLATION WILL BE SANCTIONED. ESTABLISHMENT, TRANSPORT AND CREMATORY RENEWALS MUST BE IN OFFICE BY JANUARY 31, 2010. RENEWALS RECEIVED AFTER THE 31ST ARE DELINQUENT AND ESTABLISHMENTS ARE PROHIBITED FROM CONDUCTING BUSINESS. THE FUNERAL DIRECTOR WHO MANAGES THE ESTABLISHMENT MUST SEND IN HIS/HER RENEWAL FORM WITH THE ESTABLISHMENT RENEWAL FORM. THE ARKANSAS DEPARTMENT OF HEALTH WILL BE NOTIFIED OF DELINQUENT ESTABLISHMENTS; THEY WILL NOT ACCEPT DEATH CERTIFICATES UNTIL LICENSES ARE CURRENT. ESTABLISHMENTS FOUND IN VIOLATION WILL BE SANCTIONED.
In order to renew your license(s) the form must be completed and correct fees must be included. Delinquent fees will be assessed if forms are not in the Board office by January 31, 2010. Delinquent fees are $50.00 dollars per quarter/per license. If your renewal is incomplete in any way it will be returned and a $10.00 handling fee will be assessed. If your renewal is returned and that results in delinquency, the delinquent fees will also be assessed.

Social Security Numbers |
| Act
1163 of 1997 requires that all applicants for professional licenses must report Social
Security numbers to their licensing board. If you have not previously reported your
SSN, please call 501-682-0574. |

Continuing Education Exemptions |
| Licensees are exempt the year they are licensed. If you are inactive, you are exempt.
If you are sixty-five (65) years of age and have had a license for twenty (20) consecutive
years, you are exempt. If you live out of state and do not practice in the State of
Arkansas, you are exempt. Please indicate which exemption you are claiming by
writing it on the renewal form, or you can send a letter attached to the renewal form. |

Complaint
Procedures |
 |
Complaints
must be typed, signed and notarized. |
 |
Give
the full name and address of the licensee and/or establishment
(respondents) your complaint is against. |
 |
Be
sure to include a number where you (Complainant) can
be reached. |
 |
State
facts clearly. If there are any documents that are pertinent
to the complaint, copies should be included. |
 |
Individuals
wishing to attest to or verify your complaint may submit
an affidavit. The affidavit must be typed, signed and
notarized. |
 |
After
the complaint is received in the Board office, it is
sent by certified letter to the respondent. The respondent
has 15 days from the date of receipt to respond to the
Board. Failure to respond to the complaint in the allotted
15 days is a violation. |
 |
At
the next scheduled Board meeting, following the receipt
of the Answer, the Complaint and Answer are reviewed
by the Board and the Boards Counsel for a determination
as to evidence of violations. If it is determined there
is sufficient evidence of violations, a Hearing date
is set. The Complainant and the Respondent are notified
and are expected to be present. If the Board determines
that there are no violations the Complaint is dismissed
and both Complainant and Respondent are notified. |
