3700 Arkansas
Rehabilitation Service Referrals and Activities The
Arkansas Department of Human Services and the Arkansas Rehabilitation
Service (ARS) have entered into a contract through which ARS will
assess and provide services to TEA recipients who are subject to the
time-limit and are required to participate in TEA work activities but
allege a long-term disability. ARS will determine if the alleged
disability is too severe for participation in TEA work activities or
if services can be provided through their agency which will enable the
client to move forward toward being self-sufficient. The client will
also be required to apply for SSA/SSI disability benefits. |

3710 Procedures for Referring
TEA Clients to Arkansas Rehabilitation Services (ARS)
| A TEA recipient who
alleges a long-term disability (6 months or longer) will be
referred to Arkansas Rehabilitation Services (ARS) for an
assessment to determine if the alleged disability will allow him
or her to participate in TEA work activities or other activities
through ARS. The recipient is also required to apply for SSA/SSI
disability benefits. If ARS determines that the disability is not
severe enough to prevent participation, the client must comply
with the TEA work activity requirements. If the disability is too
severe for participation in TEA work activities, ARS will
determine if they can provide services that will possibly enable
the client to enter the workforce. Failure to comply with the ARS
assessment process will result in the individual being required to
engage in a regular TEA work activity. |
When a TEA recipient alleges a long-term disability, the Case
Manager will explain the ARS referral and assessment process as
described above. Particular emphasis should be placed on the
importance of attending the interview scheduled by ARS. The client
should be made aware of the results for failure to attend the
interview, provide required information, etc. PUB-391, Arkansas
Rehabilitation Services Orientation information, will be explained and
given to the client during the application interview. PUB-391 provides
the client with information regarding the ARS referral process, what
ARS will do once the referral is received and his or her
responsibility after being referred. The client will also be advised
that supportive services will be provided if needed.
Form DCO-3350, Referral for Services, will be used for referring
the client to ARS. An explanation of the disability and a request to
receive a report of the diagnosis will be included on the referral.
The county must include form DCO-81, Consent for Release of
Information, signed by the client in order to receive a report back
from ARS regarding the diagnosis. The address for submitting the
referral is based on the county location. The county should also work
with the ARS agency to develop communication procedures to ensure that
the individual is receiving the necessary support services in order to
comply with ARS services.

3711 Responsibility of ARS
Upon receipt of the referral, ARS will contact the TEA recipient
and schedule an appointment for an assessment. ARS will notify the
local county office TEA Case Manager of the date of the assessment. If
child care or transportation services are needed, ARS will provide
notice at least two working days in advance of the assessment
appointment. ARS will also notify the TEA Case Manager within two
working days via the DCO-3300 following the date of the assessment if
the individual fails to attend the assessment.
Through this assessment, an application for services will be
completed and ARS will determine if the client can participate in a
work activity or needs further ARS services. ARS will complete the
assessment within 60 calendar days of the date the ARS application is
signed. DCO will be notified of the results within 10 working days of
completion of the assessment. A copy of the assessment results and a
Certificate of Eligibility (COE) or ineligibility (COI) will also be
provided. The decision will state that the individual has been found
to:
- Not have a significant impairment and can participate in TEA
work activities; or
- Has an impairment and can benefit from ARS services; or
- Has an impairment too severe for ARS services and should be
deferred from TEA work requirements.
ARS will also provide any additional information if appropriate. |

3712 Responsibility of County
Office
After making a referral to ARS, the Case Manager should continue
monthly contact to monitor the client’s progress. This includes
insuring that the client is receiving the supportive services needed
to comply with the ARS assessment. The ARS agency should also be made
aware of the staffings that are occurring on the case.

3720 Accepted for Services
If ARS determines that the client is eligible for services, the
Case Manager will contact the client to update the employment plan to
include the ARS activities.
The Case Manager will also explain to the recipient that
participation in this activity is mandatory and that the 24-month time
clock is continuing to run. ARS will advise the Case Manager if the
individual is in employment or education.
An individual engaged in this activity will be coded as a mandatory
participant (Refer to the DCO Users Manual for the appropriate codes).
The Case Manager will advise the recipient that failure to comply with
the ARS activity may result in the non-compliance sanction being
imposed.
ARS will complete an Individual Plan for Employment (IPE) on the
recipient within 30 days of the COE determination and provide a copy
to the TEA Case Manager within five (5) working days of the completion
of the plan.
The Case Manager will continue to monitor (at least monthly) the
individual’s progress while engaged in ARS services. Monitoring may
be conducted via phone, progress reports, etc., as determined through
the joint coordination procedures.

3725 Non-Compliance with ARS ARS
will report non-compliance by a TEA recipient to the local office from which the referral
was received. The local county office and ARS agency will coordinate communication
procedures. TEA 3500, Non-Compliance Policy and Procedures, will
be followed. |

3730 Not Accepted For Services
ARS will notify the county if an individual is not accepted for
services and provide a reason for non-acceptance as follows.
Disability Not Significant
If ARS determines that the client’s alleged disability is not
significant enough for ARS services, the Case Manager will send a
notice to the client advising of the ARS decision and that he or she
will have to comply with TEA work participation requirements. The
Case Manager should schedule an appointment with the client to
discuss work participation activities and to develop an Employment
Plan or EP update.
Refused Services
ARS will notify the county if a client refuses services. The Case
Manager will contact the client to discuss the reason for refusal.
If it is determined that the client refused services without good
cause, then the client will be required to engage in a regular TEA
Work activity.
If it is determined that the client refused services with good
cause, and that he or she does want to comply with the ARS
activities, a referral will be made to ARS. The Case Manager will
advise ARS that the individual is being re-referred for services and
include an explanation of the referral.

3740 Impairment Too Severe for
ARS Services
If ARS determines that the disability is too severe for ARS
services, the TEA recipient will be deferred from participation in TEA
work activities pending the disability determination from Social
Security. The Case Manager will contact the client advising him or her
of the deferral and that the time limit will not count in any month in
which he or she is deferred from work participation
NOTE: If SSA determines that the individual is not
disabled, the Case Manager will refer the individual to ARS for a
redetermination. The Case Manager will provide ARS with any
information that was received form SSA regarding the disability
determination decision.
