New Appendix R 4-01-04
Transfer of Resources policy at MS 3334.3 and MS 3336.10 has been revised to increase the divisor used to determine the period of ineligibility for facility vendor payments and Home and Community Based Waiver services when a transfer of assets is made for less than fair market value. The current divisor is being increased from 1700 to 3416. The revision of policy also allows for a change in the amount of the divisor each April 1st. The amount of the divisor will be based on the cost of care in a nursing facility. The new amount will be shown on the new Appendix R - Transfer of Assets Divisor. The revised policy and Appendix R are attached.
Individuals with open Medicaid cases who are currently under a penalty for transfer of resources will be reassessed at reevaluation, or earlier if requested. Individuals with denied applications will be reassessed at reapplication. If eligible when reassessed, individuals can be approved for nursing facility care or a Home and Community Based Waiver. Coverage may not begin before April 1, 2004 or before the three-month retro period, whichever is later.
