Subj: Revised Policy - Working Disabled

Effective September 15, 2001, Medicaid for the Working Disabled policy has been amended to redefine working to mean employment for which income is received and reported to the IRS. Procedural changes have also been incorporated that clarify that individuals with unearned income over the SSI/SPA for one person are not eligible in this category. Policy has also been updated to reflect the current SGA (substantial gainful activity) amount of $740.00 per month.

Cases should be evaluated to determine if the individual meets the new eligibility criteria when the worker handles the case for a change, or at the regular yearly reevaluation, whichever comes first. If the individual no longer meets the requirements for the Working Disabled category, the caseworker should determine if he/she is eligible in any other Medicaid category, and if so, certify in that category. If the individual is not eligible in any category, a 10-day advance notice of case closure should be sent, and the case closed after the 10^th day. No overpayments will be assessed for the period of coverage for individuals previously certified incorrectly.
